法律分析：一、上市公司是股份有限公司,具有股份有限公司的全部法律特征：如股东人数广泛性,股份发行转的公开性、自由性,股份的均等性,公司经营的公开性;二、上市公司是符合法定上市条件的股份有限公司。我国公司法对上市条件有严格规定,只有符合条件的股份有限公司的股票才可以在证券交易所上市交易。三、上市公司的股票在证券交易所上市交易。
法律依据：《中华人民共和国证券法》第四十八条，申请证券上市交易，应当向证券交易所提出申请，由证券交易所依法审核同意，并由双方签订上市协议。
