释义	法律分析：不属于形成权。形成权是指权利人得以自己一方的意思表示而使法律关系发生变化的权利。在遗嘱继承中，除了被继承人在遗嘱中做出有效的意思表示之外，还需遗嘱中继承人以明示或默示的方式表示接受继承，其才有效。法律依据根据2021年1月1日生效的《民法典》一千一百二十四条继承开始后，继承人放弃继承的，应当在遗产处理前，以书面形式作出放弃继承的表示；没有表示的，视为接受继承。受遗赠人应当在知道受遗赠后六十日内，作出接受或者放弃受遗赠的表示；到期没有表示的，视为放弃受遗赠。
