释义	法律分析: 我国刑法的普遍管辖权，是指凡是我国缔结或者参加的国际条约中规定的罪行，不论罪犯是中国人还是外国人，也不论其罪行发生在我国领域内还是领域外，也不论其具体侵犯的是哪一个国家或者公民的利益，只要犯罪分子在我国境内被发现，我国在我国所承担条约义务的范围内，如不引渡给有关国家，我国就有权行使刑事管辖权。《刑法》第九条对于中华人民共和国缔结或者参加的国际条约所规定的罪行，中华人民共和国在所承担条约义务的范围内行使刑事管辖权的，适用本法。
