问题	法院退回检察院补充侦查
释义	法院在审理案件的过程中不会主动的把案件退回检察院补充侦查，除非是在一审判决作出前,提起公诉的检察院向法院申请撤回起诉进行补充侦查,经法院裁定准许后才可以,检察院不主动申请法院是不能决定退回的。法律依据：《中华人民共和国刑事诉讼法》第二百零四条在法庭审判过程中，遇有下列情形之一，影响审判进行的，可以延期审理：（一）需要通知新的证人到庭，调取新的物证，重新鉴定或者勘验的；（二）检察人员发现提起公诉的案件需要补充侦查，提出建议的；（三）由于申请回避而不能进行审判的。
