合同无效，违约金条款有效吗
释义
法律分析：无效。但是合同无效的情况下，合同中独立存在的有关解决争议方法的条款、因合同无效返还由该合同取得的财产、有过错的一方应当赔偿对方因此所受到的损失，双方都有过错的，应当各自承担相应责任的条款有效。
法律依据：《中华人民共和国民法典》 第五百零七条 合同不生效、无效、被撤销或者终止的，不影响合同中有关解决争议方法的条款的效力。
