释义	当事人申请再审，应当在判决、裁定发生法律效力后6个月内提出。再审是为纠正已经发生法律效力的错误判决、裁定，依照审判监督程序，对案件重新进行的审理。不同的启动再审的部门也反映了当事人有不同的申诉救济途径，当事人不仅仅可以到中级人民法院反映诉求，也可以到省高院、检察院进行申诉。【法律依据】《民事诉讼法》第二百零五条，当事人申请再审，应当在判决、裁定发生法律效力后六个月内提出；有本法第二百条第一项、第三项、第十二项、第十三项规定情形的，自知道或者应当知道之日起六个月内提出。
