释义	法律分析：一般在判刑之前有先被羁押过的，若之后判处管制、拘役或者有期徒刑，那之前先行羁押的期限其实可以对刑期进行折抵。不过，若是被宣告缓刑的话，因为并非是实刑，而是对犯罪分子的一种考验，这样的情况下就算之前有被先行羁押，但是也不能对缓刑的日期进行折抵。法律依据：《中华人民共和国刑法》第七十三条拘役的缓刑考验期限为原判刑期以上一年以下，但是不能少于二个月。有期徒刑的缓刑考验期限为原判刑期以上五年以下，但是不能少于一年。缓刑考验期限，从判决确定之日起计算。
