释义	刑事犯罪量刑标准是指根据犯罪的案件性质和情节轻重确定犯罪嫌疑人的法定刑。根据《刑法》第62条关于从重处罚和从轻处罚的规定，从轻处罚是在法定刑的范围内比照刑罚较轻的下限来进行处罚，有两个主刑的适用较轻主刑，判决刑期也比照下限的轻量刑。但要区别于减轻处罚，不能跳出法定刑的范围，适应较轻的主刑或附加刑。【本文关联的相关法律依据】《中华人民共和国刑法》第六十二条从重处罚与从轻处罚，犯罪分子具有本法规定的从重处罚、从轻处罚情节的，应当在法定刑的限度以内判处刑罚。
