释义	法律分析: 定罪，又称为犯罪认定，是指根据刑法规定，对某一行为是否构成犯罪、构成何种犯罪以及构成的是轻罪还是重罪的确认与评判。量刑，又称刑罚裁量，是指人民法院根据刑事法律，在认定犯罪的基础上，确定对犯罪人是否判处刑罚，判处何种刑罚以及判处多重刑罚，并决定所判刑罚是否立即执行的刑事司法活动。法律依据: 《中华人民共和国刑法》第六十一条对于犯罪分子决定刑罚的时候，应当根据犯罪的事实、犯罪的性质、情节和对于社会的危害程度，依照本法的有关规定判处。
