事实行为与法律行为的关系

释义

法律主观：

1、法律行为以意思表示为其必备要素；事实行为完全不以意思表示为要素，当事人实施行为的目的并不在于追求民事法律后果。 2、法律行为依行为人意思表示的内容而发生效力；事实行为依法律的规定直接产生法律后果。 3、法律行为的本质在于意思表示，而不在于事实构成；事实行为只有在行为人的客观行为符合法定构成要件时，才发生法律规定的后果。

法律客观：

《民法典》第一百十三十三条民事法律行为是民事主体通过意思表示设立、变更、终止民事法律关系的行为。
