释义	根据我国相关法律规定可以知道，醉酒驾驶已经构成了犯罪，以危险驾驶罪定罪处罚。如果交警对司机进行酒精检测时，每100毫升血液中检测出80毫克以上酒精含量，就构成醉酒驾驶。驾驶员醉酒驾驶机动车的，由公安机关的交通管理部门约束至酒醒，并且吊销机动车驾驶证，五年内不能重新取得驾驶证。除此以外，会依法追究刑事责任，以危险驾驶罪定罪，判处拘役，并处罚金，其中拘役期限为一个月以上六个月以下。
