军人应该怎么离婚？ |

因为人民军队肩负着保护国家安全、保卫国家建设的神圣职责。对现役军人的婚姻予以特殊保护，是我国婚姻立法上的传统，也符合国家与人民的根本利益。这一规定，有利于军队秩序和军心的稳定，也充分体现了党和国家对军人的特别关怀。规定，现役军人的配偶要求离婚的，须得经军人同意，但军人一方有重大过错的除外。这是我国婚姻法对军人婚姻进行保护的一项特别规定，也就是人们通常所说得保护军婚。因此，军人的离婚手续与普通人的离婚手续存在不同。
(一)协议离婚协议离婚是指在军人和其配偶都同意离婚的情况下，由双方对子女抚养权、夫妻共同财产分割问题达成协议后，在民政局办理离婚登记。在协议离婚的情况下，军人取得所在部队政治机关可出具的同意离婚证明后，就可以前往民政局办理离婚登记。
(二)诉讼离婚军人通过提起离婚诉讼方式办理离婚时，涉及到军人离婚的管辖法院和离婚条件的问题。
军人离婚的程序根据具体情况不同而不同：
(1)如果军人一方同意离婚的，政治机关可出具证明同意离婚，双方到地方婚姻登记管理机关进行离婚登记。
(2)如果军人一方不同意离婚，政治机关不得出具证明，但经过政治机关查实军人一方确有重大过错的除外。
