释义	法律分析：向法院起诉。承包工程的包工头个人因不是《劳动合同法》所规定的合法用人单位，与其所使用的工人间，应该属于劳务雇佣关系而不是劳动合同关系，法律依据：《中华人民共和国行政诉讼法》第五十一条人民法院在接到起诉状时对符合本法规定的起诉条件的，应当登记立案。对当场不能判定是否符合本法规定的起诉条件的，应当接收起诉状，出具注明收到日期的书面凭证，并在七日内决定是否立案。不符合起诉条件的，作出不予立案的裁定。裁定书应当载明不予立案的理由。原告对裁定不服的，可以提起上诉。
