释义	法律分析：胁迫他人犯罪的，按照共同犯罪中的主犯处罚。共同犯罪主犯，是指在共同犯罪中起主要作用的犯罪分子。胁迫他人犯罪、并已经实施犯罪行为的,按照共同犯罪处罚。胁迫人按照主犯处罚,被胁迫人属于胁从犯。胁从犯是被胁迫参加犯罪的。由于胁从犯在共同犯罪中的作用小于从犯的作用，因而对胁从犯的处罚上要轻于从犯。法律依据：《中华人民共和国刑法》第二十八条【胁从犯】对于被胁迫参加犯罪的，应当按照他的犯罪情节减轻处罚或者免除处罚。
