释义	法律上没有明文规定赠与合同必须为书面形式，所以一般情况下并不要求赠与合同必须是书面形式。但是特殊情况下，譬如赠与房屋的合同应当采用书面形式。《城市房地产管理法》第41条规定：“房地产转让，应当签订书面转让合同，合同中应当载明土地使用权取得的方式。”该法第37条规定：“房地产转让，是指房地产权利人通过买卖、赠与或者其他合法方式将其房地产转移给他人的行为。”赠与房屋必须遵守这一规定。
