释义	租车人不能抵押租赁车辆给担保企业，只有使用权，不能处分。如果不归还车辆，要承担赔偿责任。租车抵押给担保企业是不合法的。租车人对车辆不享有所有权，因此只有使用权，没有抵押或其他处分权，否则就属於侵权，需承担侵权责任。如果租车人在租赁结束时未归还车辆，就必须赔偿出租人因此而遭受的损失。《民法典》第二百四十条所有权人对自己的不动产或者动产，依法享有占有、使用、收益和处分的权利。该内容由丁旭涛律师和家和律云共创回答
