法律分析:
劳动合同中明确约定用人单位可以根据需要调整工作岗位的,用人单位可以按劳动合同约定予以调整。劳动者被证明不符合试用条件,经与员工协商,可以调整岗位。
法律依据:
《中华人民共和国劳动合同法》 第三十五条 用人单位与劳动者协商一致,可以变更劳动合同约定的内容。变更劳动合同,应当采用书面形式。因此,这就对企业变更劳动合同提出了很高的要求,必须与员工协商一致,否则变更无效。
