问题	怎样定义信用卡诈骗罪
释义	1、信用卡诈骗罪，是指以非法占有为目的，利用信用卡进行诈骗活动，骗取数额较大财物的行为。2、本罪的主体是一般主体，凡达到刑事责任年龄、具有刑事责任能力的自然人均可构成。单位亦能成为本罪的主体。3、本罪在主观上只能由故意构成，并且必须具有非法占有公私财物的目的。如果行为人确无诈骗故意，即使违反有关信用卡管理规定获取了财物，也不能以犯罪论处。如不知是伪造、作废的信用卡而使用，善意透支，误用他人信用卡等，均不能作犯罪论处。法律依据《中华人民共和国刑法》第一百九十六条
