释义	离婚协议中子女抚养权的约定。对于离婚后子女的抚养问题可以在离婚协议中作出约定，在不违背法律的禁止性规定的情况下，该约定应属有效。但是一方不能通过离婚协议剥夺另一方抚养权，一方也不能通过离婚协议放弃对孩子的抚养权。【本文关联的相关法律依据】《民法典》第一千零七十六条规定，夫妻双方自愿离婚的，应当签订书面离婚协议，并亲自到婚姻登记机关申请离婚登记。离婚协议应当载明双方自愿离婚的意思表示和对子女抚养、财产以及债务处理等事项协商一致的意见。（《民法典》生效时间为2021年1月1日）
