不住院保险公司不赔营养费吗 |

交通事故中的赔偿，住院的，需要护理的，保险公司会赔偿误工费和护理费。没有住院的，要是医生出具了在家休养的证明，也要适度的赔偿误工费，但护理费就不赔偿了，在家休养的，说明能生活能自理，能自理的就不能赔偿护理费了。
还有精神损害赔偿，这个额一般都没有赔偿的，除非伤的特别重的，才能有精神损害赔偿。营养费也是一样的，一般的都没有，只有由于事故导致摸个内脏器官受损或者切除的，医生会出具营养费的诊断证明，才能给予营养费的赔偿，例如有胃切除的，会赔偿医药费。像骨折的，软组织挫伤的都没有营养费的。因为也不需要营养费，正常饮食就可以的。
法律依据:
《关于审理人身损害赔偿案件适用法律若干问题的解释》 第二十一条 即护理人员有工作而有固定收入的，按照实际减少的收入计算，没有收入的，参照当地护工从事同等级别护理的劳务报酬标准计算。 护理费是指受害人在住院治疗期间如果需要护理的，要么是伤者家属来护理，要么是雇佣专业护工进行护理，护理费就是对此而设立的赔偿项目。护理期限是从开始护理之日起，至受害人恢复生活自理能力时止。具体的期限证明，需要治疗医院或鉴定部门提供护理期限证明。如果构成伤残不能恢复生活自理能力的，应根据年龄、身体状况等因素确定合理的期限，但护理期限最长不超过20年。
