释义	现在这类问题很多，司法实践上对此并不明确。但从法理上讲，单位无权收回住房。房改是国家对其工作人员的一种福利补偿，与工作年限、学历、职位等挂钩，分得房后，房主应对房屋享有应当的财产权利。单位往往已分房为条件，强迫职工签订所谓服务承诺。这在大多数情况下是违背职工意志的，在法律上也没有依据。但司法实践中，法院一般不受理此类案件，这我认为也不妥。至于辞去公职，单位更无权阻拦，劳动者由自主择业的自由，这是受法律保护的。
