释义	法律分析：如果以非法占有的目的套取开发商或者总承包人信任拿到进度款，然后跑掉，属于诈骗。如果临时起意拿走进度款，而不进行合同条款约定的建设工作就属于民事违约。不能算侵占，因为钱是开发商或者总承包人支付给包工头进行项目建设的，支付工程价款是开发商的义务，而进行项目建设是包工头的义务。法律依据：《刑法》第二百六十六条规定，诈骗公私财物，数额较大的，处三年以下有期徒刑、拘役或者管制，并处或者单处罚金。
