批捕和逮捕是两个不同的概念，批捕是逮捕的前提，主体是人民检察院或者人民法院，逮捕是批捕的结果，主体是公安机关，没有被批准的逮捕都是非法的。
法律依据:
《中华人民共和国刑事诉讼法》 第八十条 逮捕犯罪嫌疑人、被告人，必须经过人民检察院批准或者人民法院决定，由公安机关执行。
