释义	1、摆地摊卖香烟，如果一次销售卷烟、雪茄烟50条以上不合法。 2、因为我国实行烟草专卖制度，无烟草专卖批发企业许可证的单位或者个人，一次销售卷烟、雪茄烟50条以上的，视为无烟草专卖批发企业许可证从事烟草制品批发业务。 3、任何单位或者个人不得销售非法生产的烟草制品。法律依据《中华人民共和国烟草专卖法》第十五条经营烟草制品批发业务的企业，必须经国务院烟草专卖行政主管部门或者省级烟草专卖行政主管部门批准，取得烟草专卖批发企业许可证，并经工商行政管理部门核准登记。
