释义	法律分析：确认免责条款的效力，如同确认其它民事法律行为一样，必须具备一定的法律要件。一般情况下，只要经当事人协商确定的免责条款，不违及社会公共利益，法律是承认免责条款的效力的，否则就没有合同自由可言了。确认免责条款有效，应具备以下法律要件：1、必须是双方当事人真实的意思表示；2、必须经双方当事人协商同意；3、必须符合社会公共利益要求。法律依据：《中华人民共和国民法典》第五百零六条合同中的下列免责条款无效：（一）造成对方人身损害的；（二）因故意或者重大过失造成对方财产损失的。
