释义	法律分析：一般说来，劳动争议案件劳动仲裁是前置程序，劳动争议要先经过仲裁，之后对仲裁不服才可以起诉。除了有欠条的劳动报酬可直接向法院起诉，其他劳动争议案件是需要先申请劳动仲裁的。另外，如果涉及到的是社保问题，这个只能是向检查部门或者社保部门进行投诉，仲裁和法院是不处理的。法律依据：《中华人民共和国劳动争议调解仲裁法》第四十八条劳动者对本法第四十七条规定的仲裁裁决不服的，可以自收到仲裁裁决书之日起十五日内向人民法院提起诉讼。
