释义	赌博罪在客观上表现为聚众赌博、以赌博为业两种行为。聚众赌博是指组织、召集、引诱多人进行赌博，本人从中抽头获利的行为。以赌博为业是指经常进行赌博，以赌博获取钱财为其生活或者主要经济来源的行为。赌博罪要求具有营利目的。群众娱乐活动通常在家庭成员、亲朋好友之间进行，以娱乐消遣为目的。法律依据：《刑法》第三百零三条以营利为目的，聚众赌博或者以赌博为业的，处三年以下有期徒刑、拘役或者管制，并处罚金。
