释义	用人单位安排加班不支付加班费的，由劳动行政部门责令限期支付加班费逾期不支付的，责令用人单位按应付金额50以上100以下的标准向劳动者加付补偿金。用人单位未及时足额支付劳动报酬(含加班工资)的，劳动者可以解除劳动合同并要求用人单位支付经济补偿金。在劳动关系存续期间，用人单位拖欠劳动者加班工资的，劳动者可以随时向劳动争议仲裁部门提起仲裁，要求用人单位支付加班工资，不受时效的限制在劳动关系结束后一年内，如果劳动者主张权利、向有关部门请求权利救济或者用人单位同意支付的，则仲裁时效重新计算。
