释义	子女在未成年时父母双亡，或者父母丧失抚养能力的祖父母可以得到抚养权。要求祖父母有抚养的能力、被抚养人需要抚养且被抚养人的父母死亡或者只有一方死亡，另一方无抚养能力或者父母均丧失抚养能力。祖父母自愿抚养孙子的不予以限制，但是不能附加条件。【法律依据】《中华人民共和民法典》第一千零七十四条有负担能力的祖父母、外祖父母，对于父母已经死亡或者父母无力抚养的未成年孙子女、外孙子女，有抚养的义务。有负担能力的孙子女、外孙子女，对于子女已经死亡或者子女无力赡养的祖父母、外祖父母，有赡养的义务。
