释义	法律分析：要先去申请认定工伤，劳动部门会告知已经过了认定期限，然后给一个不予以受理的文书，拿上这个文书，到工伤事故发生地，或厂家注册所在地的基层法院去起诉。虽然已经超过工伤认定时效，不能认定为工伤，但是，只要你有确切的证据能证明你的伤害是由工作原因引起的，法院一样会受理。法律依据：《中华人民共和国劳动争议调解仲裁法》第二十七条，劳动争议申请仲裁的时效期间为一年。仲裁时效期间从当事人知道，或者应当知道其权利被侵害之日起计算。
