依据我国相关法律的规定，疫情是属于不可抗力因素，新型冠状病毒疫情具有不能预见、不能避免并不能克服等的客观情况。 不可抗力因素之一：不可预见性。 如果能预见，或应该能够预见，则不构成不可抗力。 不可抗力因素之二：不可避免性。
法律依据：
《中华人民共和国刑法》 第十六条 行为在客观上虽然造成了损害结果，但是不是出于故意或者过失，而是由于不能抗拒或者不能预见的原因所引起的，不是犯罪。
