释义	法律主观：工程监理收费，对依法必须实行监理的计费额在1000万元及以上的建设工程施工阶段的收费实行政府指导价，收费标准按国家发展改革委、建设部《关于印发〈建设工程监理与相关服务收费管理规定〉的通知》（发改价格[2007]670号）规定执行；其他工程施工阶段的监理收费和其他阶段的监理与相关服务收费实行市场调节价。《建筑法》第三十一条实行监理的建筑工程，由建设单位委托具有相应资质条件的工程监理单位监理。建设单位与其委托的工程监理单位应当订立书面委托监理合同。
