释义	法律分析：批捕了不一定会判刑，实施逮捕措施的仅仅是公安机关，虽然有可能是由法院决定采取逮捕措施，但案件尚未经过审判，此时尚不能判定行为人是否真的构成犯罪，既然不能认定为犯罪，也不确定是否会做出判刑处罚。法律依据：《中华人民共和国刑事诉讼法》第八十七条公安机关要求逮捕犯罪嫌疑人的时候，应当写出提请批准逮捕书，连同案卷材料、证据，一并移送同级人民检察院审查批准。必要的时候，人民检察院可以派人参加公安机关对于重大案件的讨论。
