释义	当前我国法律未对婚外情现象实施惩罚。婚外情只是偶尔地与婚外异性发生性关系，不承担民事责任，在婚姻法上没有什么后果，属于道德调整的范围。但如果婚外情成重婚或者与他人同居的，离婚时需要对无过错方进行赔偿。法律依据：《中华人民共和国民法典》第一千零九十一条有下列情形之一，导致离婚的，无过错方有权请求损害赔偿:(一)重婚;(二)与他人同居;(三)实施家庭暴力;(四)虐待、遗弃家庭成员;(五)有其他重大过错。
