释义	当前我国法律未对婚外情‍现象实施惩罚。婚外情只是偶尔地与婚外异性发生性关系,不承担民事责任,在婚姻法上没有什么后果，属于道德调整的范围。如果一方有婚外情导致双方感情破裂的，《婚姻法》规定可作为离婚的合法条件之一。同时，有婚外情的一方作为婚姻中的过错方，在离婚时另一方可要求精神上的赔偿。《婚姻法》第四十六条，有下列情形之一，导致离婚的，无过错方有权请求损害赔偿：（一）重婚的；（二）有配偶者与他人同居的。
