释义	除权判决指法院作出的宣告票据无效的判决。法院作出除权判决应当具备两个前提条件：公示催告期间届满无人申报权利，或是有人申报权利，但被法院裁定驳回申报；申请人在法定期间内请求法院作出除权判决。除权判决是公示催告程序的最后阶段，但却不是必经阶段。只要在除权判决作出之前，有人申报权利，即使申请人请求作出除权判决，法院也不能作出除权判决，而只能裁定终结公示催告程序。同样，公告期间届满，虽无人申报权利，但申请人并未在法定期间内申请作出除权判决，法院仍不能主动作出除权判决。
