释义	法律分析: 医疗损害是指因医疗机构及其医务人员的故意或过失(即医疗过错)，而对就医患者造成身体上或精神上的损害结果。在诉讼实践中，因医务人员的故意或者重大过失而造成患者医疗损害的，视情可构成刑法上的医疗事故罪，则由刑法对其进行调整；因医务人员的一般过失而造成患者医疗损害的，属民事侵权行为，应由医疗机构承担医疗损害赔偿责任。法律依据: 《中华人民共和国民法典》第一千一百六十七条侵权行为危及他人人身、财产安全的，被侵权人有权请求侵权人承担停止侵害、排除妨碍、消除危险等侵权责任。
