分包是不是合同转让
释义
分包不属于合同转让。法律规定禁止承包单位将其承包的全部建设工程转给他人。工程分包是承包人经发包人同意后，分包给第三人，但是合同的主体仍然是发包人和承包人；而合同转让后，合同的主体变为一方当事人与第三人。
