释义	法律分析: 破产企业以划拨方式取得的国有土地使用权不属于破产财产；在企业破产时，有关人民政府可以予以收回，并依法处置。法律依据: 《城市房地产管理法》第二十二条土地使用权划拨，是指县级以上人民政府依法批准，在土地使用者缴纳补偿、安置等费用后将该幅土地交付其使用，或者将土地使用权无偿交付给土地使用者使用的行为。依照本法规定以划拨方式取得土地使用的，除法律、行政法规另有规定外，没有使用期限的限制。
