释义	法律分析:根据我国《中华人民共和国民法典》中针对无效婚姻的规定,在我国法律框架中无效婚姻的财产应当平均分割。因为无效的婚姻就是认为双方当事人之间从来没有存在过婚姻,所以不存在婚姻关系也即不存在婚姻共同财产。但是应当按照同居关系进行处理,而在同居期间,应当以财产共同共有的关系进行处理。法律依据:《最高人民法院关于适用〈中华人民共和国民法典〉婚姻家庭编的解释(一)》第二十二条被确认无效或者被撤销的婚姻,当事人同居期间所得的财产,除有证据证明为当事人一方所有的以外,按共同共有处理。
