释义	法律分析: 在驾驶证到期的当月起一年时间内都可以办理的换证手续,超过一年了之后原证件将会被注销而且不能再办换证的手续了。原证到期了之后就会自动失效,然后在新证没有办到手之前,如果持原证驾车被查了,将视为无证驾驶从而会受到相应的处罚。法律依据: 《机动车驾驶证申领和使用规定》第六十一条机动车驾驶证审验内容包括：（一）道路交通安全违法行为、交通事故处理情况；（二）身体条件情况；（三）道路交通安全违法行为记分及记满12分后参加学习和考试情况。
