释义	法律分析：公司转让后，原公司债务由变更后的公司承担。公司所产生的债权债务并不一定跟随法人的变动而变动，公司以自己的名义承担对外的债权债务。公司法人的变更不影响公司偿还债务和享有债权。但如果公司法人在对外经济活动中，存在恶意或者过失，公司在承担对外债务的同时也可以要求原法人承担责任。法律依据：《中华人民共和国民法典》第百七十六条公司分立前的债务由分立后的公司承担连带责任。但是，公司在分立前与债权人就债务清偿达成的书面协议另有约定的除外。
