释义	法律分析: 口头赠与从理论上讲不能说无效,只要是赠与人真实意思的表示,受赠人又愿意接受赠与,这赠与就算有效的。问题是要有证据证明赠与的存在,如果没有证明存在这口头赠与,就不能听受赠人的一面之词而损害其它法定继承人的合法权益。法律依据: 《中华人民共和国民法典》第六百五十七条赠与合同是赠与人将自己的财产无偿给予受赠人，受赠人表示接受赠与的合同。
