释义	法律分析：如果已经立案的话，就得经过公安机关的侦查，侦查终结后公安机关认为不构成犯罪的才决定撤销案件。受害人可以就刑事附带民事部分接受调解。法律依据：《公安机关办理刑事案件程序规定》第一百八十三条经过侦查，发现具有下列情形之一的，应当撤销案件：（一）没有犯罪事实的；（二）情节显著轻微、危害不大，不认为是犯罪的；（三）犯罪已过追诉时效期限的；（四）经特赦令免除刑罚的；（五）犯罪嫌疑人死亡的；（六）其他依法不追究刑事责任的。
