释义	婚约彩礼纠纷案件，原则上以婚约双方当事人作为诉讼主体。但下列情形除外： 1、订立婚约的当事人为未成年人的，婚约当事人与其监护人作为共同诉讼主体； 2、给付彩礼一方的婚约当事人虽已成年，但与其父母共同生活，并用家庭财产给付彩礼的，婚约当事人与其父母可以作为共同原告； 3、接受彩礼一方的婚约当事人虽已成年，但与其父母共同生活，并将所接受的彩礼用作家庭共同生活的，可根据原告的选择将婚约当事人和其父母作共同被告； 4、婚约当事人的父母不得单独作为诉讼主体。
