善意取得不是占有。善意占有是指占有人不知道或者不应当知道自己无占有的权利而为的占有。善意取得是指动产占有人以动产所有权的移转或其他物权的设定为目的，移转占有于善意第三人时，即使动产占有人无处分动产的权利，善意受让人仍可取得动产所有权或其他物权的制度。
一、善意取得的条件
根据我国民法典的有关规定，所有权可以善意取得，但是应当符合以下条件：
（一）受让人受让该不动产或者动产时是善意；
（二）以合理的价格转让；
（三）转让的不动产或者动产依照法律规定应当登记的已经登记，不需要登记的已经交付给受让人。
占有改定不适用善意取得。善意取得适用占有委托物，不适用占有脱离物，占有脱离物是指非基于真权利人的意思丧失占有的物，比如脏物、遗失物、漂流物、埋藏物、隐藏物等，这样是为保护受让人的权利，保护国家利益。
二、民法典房产的所有权是否包含物权
民法典规定，所有权是物权的一种，所以房屋所有权不包括物权，而房屋物权包括所有权。《中华人民共和国民法典》第一百一十四条【物权的定义及类型】民事主体依法享有物权。物权是权利人依法对特定的物享有直接支配和排他的权利，包括所有权、用益物权和担保物权。第二百零九条【不动产物权登记的效力】不动产物权的设立、变更、转让和消灭，经依法登记，发生效力；未经登记，不发生效力，但是法律另有规定的除外。依法属于国家所有的自然资源，所有权可以不登记。
