释义	一方赌博所借的债务，由于该债务未用于夫妻共同生活和家庭生活，属于一方个人不合理的开支，不属于夫妻共同债务的范围，因而应由举债人个人自行承担，配偶另一方不承担偿还责任。应当指出的是，根据我国法律规定，违法的债务不受法律保护。赌博，为我国法律所明令禁止，赌债属于非法债务，不受法律保护。如果出借人明知举债人所借债务用于个人赌博的，其债权也同样不受法律保护。最高人民法院《关于人民法院审理借贷案件的若干意见》第十一条规定：“出借人明知借款人是为了进行非法活动而借款的，其借贷关系不予以保护”。
