释义	根据民法典相关规定，损害赔偿能否约定免除情况如下： 1、如果是人身损害赔偿不能约定免除； 2、如果一方是故意或者重大过失造成对方财产损失的，不能约定免除；除此之外的损害赔偿可以约定免除。【法律依据】《中华人民共和国民法典》第五百零六条合同中的下列免责条款无效：（一）造成对方人身损害的；（二）因故意或者重大过失造成对方财产损失的。第一千一百八十四条侵害他人财产的，财产损失按照损失发生时的市场价格或者其他合理方式计算。
