法律分析：月计薪天数：（365天－104天）÷12月=21.75天（不扣除11天的法定节假日）。
法律依据：《工资支付暂行规定》 第十三条 用人单位安排劳动者法定休假日工作的，应当按不低于劳动合同规定的日工资或者小时工资的300%支付工资报酬。劳动合同规定的工资标准，是指劳动合同规定的劳动者本人所在的岗位（职位）相对应的工资标准。劳动合同没有约定的，按照集体合同规定 计算。劳动合同与集体合同均没有约定的，按照本人正常工作期间实际工资标准计算。
