释义	要视情况而定，严重的是要坐牢的。在很多人的观念里面，只要发生了医疗事故的，那么就都会构成刑事犯罪，即医疗事故罪。但其实并不是这样的，对于医疗事故行为，只有在符合了一定标准之后，才能认定该行为构成医疗事故罪，之后才能根据《刑法》中的规定，追究行为人的刑事责任。法律依据：《中华人民共和国刑法》第三百三十五条医务人员由于严重不负责任，造成就诊人死亡或者严重损害就诊人身体健康的，处三年以下有期徒刑或者拘役。
